1. General Information
These Terms & Conditions (“Terms”) govern all services provided by NextLevel Translations (“Provider”, “we”, “us”) to clients (“Client”, “you”), including translation, localization, proofreading, MTPE (machine translation post-editing), subtitle localization and related linguistic services.
By requesting or using our services, the Client agrees to these Terms & Conditions.
2. Scope of Services
The Provider offers professional English → German language services, including but not limited to:
- Translation
- Localization
- Proofreading
- Editing
- MTPE
- Subtitle translation
- QA and terminology review
- Multilingual content adaptation
The exact scope of each project shall be defined individually through written communication, quotations or project agreements.
3. Quotes and Project Acceptance
All quotations are non-binding unless otherwise agreed in writing.
A project is considered accepted once:
- the Client confirms the quotation in writing,
- submits project materials for processing,
- or otherwise authorizes work to begin.
The Provider reserves the right to refuse projects at their discretion.
4. Pricing and Payment Terms
Prices are determined individually based on factors such as:
- word count,
- complexity,
- technical difficulty,
- formatting requirements,
- turnaround time,
- and project scope.
Unless otherwise agreed:
- invoices are payable within 30 calendar days from the invoice date,
- payments must be made in full and without deductions,
- late payments may result in suspension of ongoing work.
For larger or long-term projects, advance payments or milestone payments may be required.
The Client is responsible for any transfer fees, currency conversion fees or banking charges.
5. Delivery and Turnaround Times
Delivery deadlines are agreed individually for each project.
The Provider shall make reasonable efforts to meet agreed deadlines. However, deadlines may be adjusted in cases involving:
- force majeure,
- technical issues,
- delayed client feedback,
- incomplete project materials,
- or unforeseen circumstances.
Delivery is considered completed once files are sent via:
- email,
- cloud service,
- CAT tool platform,
- or other agreed delivery method.
6. Revisions and Corrections
Clients are encouraged to review delivered work promptly.
Reasonable correction requests directly related to the original project scope are generally provided free of charge if submitted within 14 days after delivery.
Revisions caused by:
- changed source texts,
- additional content,
- altered project instructions,
- stylistic rewrites,
- or subjective preference changes
may be billed separately.
The Provider reserves the right to determine whether a requested modification constitutes a correction or additional work.
7. Client Responsibilities
The Client is responsible for:
- providing complete and accurate source materials,
- supplying reference documents where relevant,
- clarifying terminology preferences,
- ensuring legal rights to submitted content,
- and reviewing delivered work for suitability before publication.
The Provider is not responsible for errors resulting from:
- incomplete instructions,
- incorrect source materials,
- outdated terminology,
- or post-delivery modifications by third parties.
8. Confidentiality
All client materials and project-related information shall be treated as confidential.
The Provider agrees not to disclose confidential information to third parties except where:
- required for project execution,
- legally required,
- or explicitly authorized by the Client.
Reasonable technical and organizational measures are used to protect confidential information. However, absolute security of electronic communication cannot be guaranteed.
The Client likewise agrees not to disclose confidential pricing, workflows or proprietary business information belonging to the Provider.
9. Intellectual Property
Unless otherwise agreed in writing, intellectual property rights to the final delivered translation transfer to the Client only after full payment has been received.
The Provider retains the right to:
- use general linguistic knowledge gained during projects,
- reference publicly known clients for portfolio purposes unless confidentiality agreements prohibit this,
- and retain internal translation memories and glossaries where legally permissible.
Source texts and trademarks remain the property of their respective owners.
10. Limitation of Liability
The Provider shall perform services with reasonable professional care and diligence.
However, the Provider shall not be liable for:
- indirect damages,
- consequential damages,
- loss of profits,
- business interruption,
- reputational damage,
- or losses arising from third-party use of translated materials.
The Client remains responsible for:
- final verification,
- legal review,
- regulatory compliance,
- and publication approval of all delivered content.
In all cases, the Provider’s maximum liability shall be limited to the total amount paid for the specific project giving rise to the claim.
11. Force Majeure
The Provider shall not be held liable for delays or failure to perform caused by events beyond reasonable control, including but not limited to:
- natural disasters,
- internet outages,
- illness,
- power failures,
- cyberattacks,
- labor disputes,
- governmental actions,
- or technical platform failures.
12. Termination
Either party may terminate ongoing cooperation in writing.
If a project is terminated after work has begun, the Provider shall be entitled to payment for all work completed up to the termination date.
Any completed partial work may be delivered upon payment.
13. Website and Communication
Information provided on https://nextlevel-translations.com/ is for general informational purposes only and does not constitute a binding offer unless explicitly stated.
Communication via email or website forms does not automatically establish a contractual relationship.
14. Applicable Law
These Terms & Conditions shall be governed by the laws of the Federal Republic of Germany.
Where legally permissible, the place of jurisdiction shall be the Provider’s place of business in Germany.
15. Severability Clause
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
16. Changes to These Terms
The Provider reserves the right to modify these Terms & Conditions at any time.
The latest version published on the Website shall apply unless otherwise agreed in writing.
